1. Scope, provider
1.1 These General Terms and Conditions apply to all orders placed by consumers and businesses via our online shop at www.feuerwerk-belgien.com.
1.2 Your contracting partner is:
Stone-Store Batihome SRL, trading under the brand “Fireworks Belgium”
Aachener Straße 212, 4730 Hauset, Belgium
Company number / VAT no.: BE0567676167
Phone: +32 473 86 21 13 · Email: hello@fireworks-belgium.be
Further details can be found in our Legal notice.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.
1.4 Deviating terms of the customer apply only if we expressly agree to them in writing.
2. Product range, age limits and sales restrictions
2.1 We sell pyrotechnic articles only within the scope of the regulations applicable in Belgium, in particular the Royal Decree of 20 October 2015 on making pyrotechnic articles available on the market, as amended. The category of an article is stated in the product description and on the label.
2.2 The following statutory minimum ages apply:
- Category F1 fireworks: from 12 years;
- Category F2 fireworks: from 16 years;
- Category P1 pyrotechnic articles: from 18 years, and only those P1 articles that may be supplied to consumers under Belgian law.
By way of derogation, for safety reasons we supply category F2 fireworks only to persons aged 18 or over.
2.3 Articles that may only be supplied to persons with specialist knowledge are sold only on presentation of a valid licence. Before handing them over, we check the validity of the licence in the official register and keep a copy of the licence together with the invoice, as required by Belgian law.
2.4 By placing your order, you confirm that you have reached the minimum age required for the ordered articles and, where required, hold a valid licence. We check this at pickup (clause 6.3).
3. Conclusion of the contract
3.1 The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order. Availability information is given to the best of our knowledge; particularly popular articles may sell out quickly in season.
3.2 You can add products to the cart without obligation. During the ordering process you enter your details and choose the payment method. Before submitting, you see an overview of your order with the total price and the notice that the goods can only be collected in Hauset. By clicking the button “Order with obligation to pay” you place a binding order for the goods in the cart.
3.3 Our shop automatically confirms receipt of your order by email. This acknowledgement of receipt does not yet constitute acceptance of your order.
3.4 The purchase contract is concluded when we accept your order. Acceptance takes place by making the goods available for collection, which we notify you of with the email “Your order is ready for pickup” (clause 6.2), but at the latest upon handover of the goods. Payment is made on collection in cash or by card (clause 7).
Even with payment at pickup, the contract is concluded online; the statutory right of withdrawal under clause 8 applies.
3.5 If an ordered article is, contrary to our display, no longer available, we will inform you without delay. Any payments already made for this article will be refunded without delay.
4. Contract language, storage of the contract text, correction of input errors
4.1 The contract language is German.
4.2 We store the contract text. You receive the order details with the automatic confirmation of receipt by email. These terms and the withdrawal policy linked in them (clause 8) are available at any time at www.feuerwerk-belgien.com/agb and can be saved and printed there.
4.3 You can identify and correct input errors before submitting the order: in the cart you can change quantities and remove articles; in the following steps you can change your details via the edit buttons or links or with your browser’s back function. The order is only submitted when you click “Pay now”.
5. Prices
All prices are final prices and include statutory VAT. As we offer pickup only, there are no shipping or delivery costs.
6. Pickup, pickup period, age and licence checks
6.1 We do not ship goods. Articles ordered online are exclusively picked up in our shop: Aachener Straße 212, 4730 Hauset, Belgium.
6.2 As soon as your order is ready for pickup, we notify you by email (“Your order is ready for pickup”). Your order is usually ready on the same day, faster by appointment; you can collect it during our opening hours or at the agreed time. Please collect your order within 14 days of placing it. Collection may also be made by a person authorised by you who personally meets the requirements of clause 6.3 and presents the order number and a written authorisation.
6.3 We are legally obliged to check age at handover. The goods are therefore handed over only on presentation of a valid official photo ID; for articles under clause 2.3, additionally only on presentation of a valid licence. We do not make a copy of the ID.
6.4 If the required minimum age or the required licence cannot be proven at pickup, we may not hand over the articles concerned. In this case, both parties are entitled to withdraw from the contract to that extent; any amounts already paid for these articles will be refunded in full and without delay via the original means of payment.
6.5 If you do not pick up your order within the period under clause 6.2, a further period of 7 days applies. If the goods are not picked up within this period either, we may withdraw from the contract; any amounts already paid will then be refunded in full. Mere failure to pick up does not constitute a withdrawal (see clause 8).
6.6 The risk of accidental loss and accidental deterioration of the goods passes to you or the person authorised by you upon handover.
7. Payment
7.1 Payment is made exclusively at pickup in our shop in Hauset: in cash or by card (Visa, Mastercard, Bancontact) or Google Pay. Online payment via our website is not possible; no payment data is requested when ordering and nothing is charged.
7.2 We do not offer any other payment methods, in particular cash on delivery, invoice or prepayment by bank transfer.
7.3 For card payments, the terms of the respective means of payment apply in addition. We do not charge any additional fees for payment.
8. Right of withdrawal
8.1 Consumers have a statutory right of withdrawal of 14 days for orders placed in our online shop, even if the goods are collected in the shop. Details, in particular on the start of the period, return and refund, can be found in our Withdrawal policy including the model withdrawal form.
8.2 We do not grant businesses a voluntary right of withdrawal.
9. Warranty and customer service
9.1 The statutory liability for defects applies. For consumers, the statutory warranty period for new goods is two years from handover. For businesses, the warranty period is one year from handover, insofar as legally permissible.
9.2 Please observe the expiry date stated on the article and the manufacturer’s storage instructions. Defects caused by improper storage, moisture or improper use after handover are not material defects.
9.3 For complaints and questions you can reach us at +32 473 86 21 13 or hello@fireworks-belgium.be. Please bring faulty pyrotechnic articles to our shop by arrangement; do not send them by post or parcel service, as fireworks are dangerous goods.
9.4 Information on any manufacturer’s guarantees can be found with the respective product. Statutory rights remain unaffected by guarantees.
10. Liability
10.1 We are liable without limitation in cases of intent and gross negligence, injury to life, body or health, under the mandatory provisions of product liability law and in the case of a guarantee given.
10.2 In the event of a slightly negligent breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely, our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded, insofar as legally permissible.
11. Safety information, taking articles abroad
11.1 Always follow the instructions for use, the safety distances and the age information on the article. Do not modify pyrotechnic articles; store them in a dry place, out of the reach of children and away from heat and open flames.
11.2 The transport, possession and use of pyrotechnic articles outside Belgium, in particular in Germany and the Netherlands, are subject to the regulations applicable there (e.g. on permitted categories, sales periods and times of use). The customer is responsible for compliance with them. On request, we will gladly advise you on the categories of our articles.
12. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have any questions or complaints, please contact us directly; we will endeavour to find an amicable solution.
13. Applicable law, place of jurisdiction
13.1 Belgian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer, this choice of law applies only insofar as it does not deprive the customer of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
13.2 If the customer is a business, the place of jurisdiction for all disputes arising from this contract is our registered office. For consumers, the statutory places of jurisdiction apply.
13.3 Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
